Mastering Open Source and Legal Pitfalls
Open Source is recognized as the greatest catalyst for creators and consumers of software, but legal pitfalls may derail projects and companies relying on it. Discover the issues and solutions most appropriate for safe adoption of OS software in an open world.
The growing use of Open Source and economics of outsourcing have made testing for intellectual property (IP) cleanliness and proper satisfaction of legal obligations an essential task for ensuring quality and market acceptability. Real or perceived IP issues can delay product cycles and derail entire projects or business transactions. This panel of experts will cover the important legal aspects of Open Source adoption, and the tools and procedures for safe adoption and management of Open Source software in large as well as small and mid-size organizations:
- Discussion of issues concerning commercialization of software-intensive products in the wake of accelerated adoption of Open Source software and extensive use of outsourcing.
- Examination of the requirements, processes and techniques available for proper software IP management and code portfolio mapping necessary to avoid legal pitfalls The performance/cost efficiencies of various techniques will be evaluated. Business results of developing appropriate Software Bill-of-Materials records and applying corrective and preventive tools for software IP management will also be discussed.

Session Leader: Steven L. Grandchamp, President & CEO Open Logic Inc.
A thorough analysis of how successful companies navigate the open source waters and ensure they are complying with their open source policies and open source licensing leads to 5 key steps for the safe and successful adoption of open source in the enterprise:
- Creating an open source policy
- Selecting & provisioning open source
- Auditing open source usage
- Complying with open source licenses
- Supporting open source in production

“Efficient Mastering of Open Source in Small and Mid-Size Organizations”
Session Leader: Mahshad Koohgoli, President & CEO Protecode Inc.
3rd generation tools and real-time “legal obligation discovery” techniques are enabling the use of a simplified workflow for the safe and efficient adoption and transfer of open source and other external code, even for small and mid-size organizations. These tools do not require any special training of software developers and do not disturb the normal process of development. Such “forward open source adoption workflow” maintains developer freedom of choosing most applicable open source solutions.
11.50-12.05
“Quality Assurance in an Embedded Open World”
Session Leader: Mr. Neil Langmead, CEO Emenda Inc.
Real-time systems have become quite complex with software components embedded in many chips, subsystems and application layers, most of which make use of open source. This presentation looks at a strategy to enforce licensing / ownership and compliance issues at the developer desktop, and how this leads to increased quality and confidence in the released applications, simultaneously reducing IP infringement risks, and the risks of defects escaping into the field post-release.
12.05-12.20
Best Practice in the Commercialization of IP from ICT Based Research”
Session Leader: Dr. John McGuire, Commercialization Executive, National University of Ireland
The key activities required to identify, protect, and commercialist the IP developed in an ICT based research institute will be discussed, with emphasis on issues pertaining to extensive use of Open Source solutions. The presentation will identify the key activities required to identify, protect and commercialize the IP developed. Each activity will be defined and best practice in managing these activities will be introduced through a case study.
12.20-12.35
"Legal Issues from Global to Local: a QualiPSo Initiative”
Session Leader: Stephane Dalmas, Legal Issues Leader, QualiPSo Project, INRIA
Although FLOSS is global, Law is local, and the differences that may affect FLOSS are not only on the handling of Intellectual Property but also on contract laws, liabilities, consumer laws... We will discuss an initiative taking place in the QualiPSo European project to build a reference site to centralize the existing knowledge on legal issues related to FLOSS. It focuses on the different national laws to provide a resource of accurate, organized and qualified information to lawyers and working practitioners worldwide.

Stephane Dalmas
Stéphane Dalmas earns a PhD in Computer Science and works at INRIA (Institut National de Recherche en Informatique et en Automatique), the leading French research institute in IT. After spending ten years investigating various problems in symbolic computation (programming languages, user interface, code generation, deductive formula databases, representation of mathematical objects, automatic differentiation), he joined the technology transfer and industrial partnership team. As INRIA considers FLOSS as another powerful means to transfer its research results to the industry and society, he became involved in the CeCILL effort, coordinating the work on the second version of the license and on CeCILL-B and CeCILL-C to produce the first coherent family of FLOSS licenses with a high legal quality. Stéphane is the leader of the "Legal Issues" activity of the QualiPSo European project on the quality of Open Source.
